Operational Permit
Additive Manufacturing (Section 105.5.1)
An operational permit is required for industrial additive manufacturing operations (3D printing) that utilize combustible powders or metals, an inert gas supply, a combustible dust collection system or create a hazardous (classified) location area or zone outside the equipment.
Aerosol Products (Section 105.5.2)
An operational permit is required to manufacture, store, or handle an aggregate quantity of Level 2 or Level 3 aerosol products, aerosol cooling spray products, or plastic aerosol products in excess of 500 pounds net weight. Aerosol Products may be permitted under the Hazardous Materials Operational Permit.
Amusement Buildings (Section 105.5.3)
An operational permit is required to operate a special amusement building (a temporary, permanent or mobile building that contains a device or system that conveys passengers or provides a walkway along, around or over a course in any direction as a form of amusement arranged so that the egress path is not readily apparent due to visual or audio distractions or an intentionally confounded egress path, or is not readily available because of the mode of conveyance through the building or structure). Examples include escape rooms, haunted houses, indoor miniature golf, lasertag, airsoft, or similar arenas, houses of mirrors, or similar type buildings or structures. Amusement building operational permits shall be renewed annually or if the pathway or movement through the building changes.
Child Day Cares (Section 105.5.53)
An operational permit is required to operate a child day care center. Day cares operating in public and private school facilities are excluded. The permit fee for Child Day Cares is $35 in residential buildings and $75 in commercial buildings.
Combustible Dust-producing Operations (Section 105.5.7)
An operational permit is required to operate a grain elevator, flour starch mill, feed mill, or plant pulverizing aluminum, coal, cocoa, magnesium, spices or sugar, or other operations producing combustible dust. Combustible dust is defined as finely divided solid material which is 420 microns or less in diameter and which, when dispersed in air in the proper proportions, could be ignited by a flame, spark, or other source of ignition. Combustible dust will pass through a U.S. No. 40 standard sieve.
Combustible Fibers (Section 105.5.8)
An operational permit is required for the storage and handling of combustible fibers in quantities greater than 100 cubic feet. A permit is not required for agricultural storage. Combustible fibers are readily ignitable and free-burning materials in a fibrous or shredded form, such as coca fiber, cloth, cotton, excelsior, hay, hemp, henequen, istle, jute, kapok, oakum, rags, sisal, Spanish moss, straw, tow, wastepaper, certain synthetic fibers, and other like materials. It does not include densely packed baled cotton. A permit is not required for agricultural storage.
Compressed Gases (Section 105.5.9)
An operational permit is required for the storage, use or handling at normal temperature and pressure (NTP) of compressed gases in excess of the amounts listed in Table 105.5.9. Compressed gases may be permitted under the Hazardous Materials Operational Permit.
Dry Cleaning (Section 105.5.13)
An operational permit is required to engage in the business of dry cleaning or to change to a more hazardous cleaning solvent used in existing dry-cleaning equipment. This is specific to dry-cleaning plants, and not drop off locations
Energy Storage Systems (ESS) (Section 105.5.14)
An operational permit is required for stationary ESS and for mobile ESS deployment operations.
Explosives (Section 105.5.16)
An operational permit is required for the manufacturing, storage, handling, sale or use of any quantity of explosive, explosive materials, fireworks, or pyrotechnic special effects. Permit Fee is $75.00 per day plus $60.00 per hour for Fire Marshal Stand By. Storage in Group R-3 occupancies of smokeless propellant (less than 20 pounds), black powder (less than 20 pounds), and small arms primers (less than 10,000) for personal use and not for resale does not require a permit.
Flammable and Combustible Liquids (Section 105.5.18)
An operational permit is required when storing, using, or handling flammable and combustible liquids as identified in Section 105.5.18. Flammable and combustible liquids may be permitted under the Hazardous Materials Operational Permit.
Hazardous Materials (Section 105.5.22)
An operational permit is required to store, transport on site, dispense, use, or handle hazardous materials in excess of the amounts listed in Table 105.5.22.
HPM Facilities (Section 105.5.23)
An operational permit is required to store, handle, or use hazardous production materials (semiconductor manufacturing)
Hot Work Operations (Section 105.5.25)
An operational permit is required for hot work operations including, but not limited to:
1. Public exhibitions and demonstrations where hot work is conducted.
2. Use of portable hot work equipment inside a structure.
Exception:
Work that is conducted under a construction permit issued by Development Services or the Victoria Fire Marshal’s Office.
3. Fixed-site hot work equipment, such as welding booths.
4. Hot work conducted within a wildfire risk area.
5. Application of roof coverings with the use of an open-flame device.
Exception:
Work that is conducted under a Re-Roof or Roof Recover permit from Development Services.
6. Where approved, the FMO may issue a permit for a hot work program. This program allows approved personnel to regulate their facility’s hot work operations.
Liquid- or Gas-Fueled Vehicles or Equipment in Assembly Buildings (Section 105.5.28)
An operational permit is required to display, operate, or demonstrate liquid- or gas-fueled vehicles or equipment in assembly buildings.
LP-Gas (Section 105.5.29)
An operational permit is required for the storage and use of LP-gas in excess of 500-gallon water capacity.
Magnesium (Section 105.5.30)
An operational permit is required to melt, cast, heat treat or grind more than 10 pounds of magnesium.
Miscellaneous Combustible Storage (Section 105.5.31)
An operational permit is required to store in any building or on any premises in excess of 500 cubic feet of combustible empty packing cases, boxes, barrels or similar containers, combustible pallets, rubber tires, rubber, cork, or similar combustible materials.
Open Flames and Torches (Section 105.5.35)
An operational permit is required to remove paint with a torch or use a torch or open flame in a wildfire risk area.
Open Flames and Candles (Section 105.5.36)
An operational permit is required to use open flames or candles in assembly areas, dining areas of restaurants, or drinking establishments. An exception is provided for houses of worship and sprinklered assembly occupancies.
Places of Assembly (Section 105.5.39)
An operational permit is required to operate a drinking establishment, bar, nightclub, or similar establishment, regardless of status with TABC (includes BYOB type businesses).
Plant Extraction System (Section 105.5.40)
An operational permit is required to use plant extraction systems.
Pyrotechnic Special Effects Material (Section 105.5.42)
An operational permit is required for use and handling of pyrotechnic special effects material.
Pyroxylin Plastics (Section 105.5.43)
An operational permit is required for storage or handling of more than 25 pounds of cellulose nitrate plastics, and for the assembly of manufacture of articles involving pyroxylin plastics.
Refrigeration Equipment (Section 105.5.44)
An operational permit is required to operate a mechanical refrigeration unit or system. See Section 608. Refrigeration Equipment may be permitted under the Hazardous Materials Operational Permit.
Repair Garages (Section 105.5.45)
An operational permit is required for the operation of repair garages.
Rooftop Heliports (Section 105.5.46)
An operational permit is required for the operation of a rooftop heliport.
Spraying or Dipping (Section 105.5.47)
An operational permit is required to conduct a spraying or dipping operation utilizing flammable or combustible liquids, or the application of combustible powders. Also includes powder coating and hydro graphics.
Storage of Scrap Tires and Tire Byproducts (Section 105.5.48)
An operational permit is required to establish, conduct, or maintain storage of scrap tires and tire byproducts that exceeds 2,500 cubic feet of total volume, and for the indoor storage of scrap ties and tire byproducts.
Temporary Membrane Structures and Tents (Section 105.5.49)
An operational permit is required to operate an air-supported temporary membrane structure, a temporary special event structure, or a tent have an area in excess of 400 square feet.
Exceptions:
- Tents used exclusively for recreational camping.
- Tents open on all sides, which comply with all of the following:
- Individual tents having a maximum size of 700 square feet.
- The aggregate area of multiple tents placed side by side without a fire break clearance of not less than 12 feet shall not exceed 700 square feet total.
- A minimum clearance of 12 feet to structures and other tents shall be provided.
Waste Handling (Section 105.5.51)
An operational permit is required for the operation of wrecking yards, junk yards and waste-handling facilities.
